New York Yacht Club challenges America's Cup governing structure
The New York Yacht Club (NYYC) has formally requested that the New York Attorney General’s Charities Bureau investigate the America's Cup Partnership (ACP). The club seeks to determine if the newly established ACP is compatible with the Deed of Gift, the 1887 charitable trust that has governed the competition for over 160 years.
Commodore Clare Harrington stated that the club is not filing a lawsuit but is instead asking the bureau to review how the trust is being administered and to obtain the Partnership Agreements, which have not been released to the public. The NYYC contends that the Deed of Gift establishes a cycle-by-cycle structure between a Defender and a Challenger of Record, whereas the ACP functions as a permanent, centrally managed body intended to manage and commercialize the event across multiple cycles.
The 38th America's Cup is scheduled to take place in Naples in 2027. The founding teams of the ACP include Emirates Team New Zealand, Athena Racing, Luna Rossa, Alinghi, and K-Challenge.
