New Zealand Parliament passes bill to block climate liability lawsuits

The New Zealand Parliament has passed the Climate Change Response (Tort Liability) Amendment Bill, which prevents companies from being sued under tort law for greenhouse gas emissions. The legislation passed its third reading with 67 votes in favor and 53 against.

Minister Paul Goldsmith stated the law provides business certainty and ensures that greenhouse gas policy implementation remains the responsibility of the elected government and Parliament. The bill was introduced in response to legal challenges, such as the case brought by activist Mike Smith against companies including Z Energy and Fonterra.

Critics and legal experts have raised concerns regarding the impact on democratic rights and the rule of law. While the government maintains the bill does not remove existing rights, opponents argue it prevents individuals from pursuing legal remedies for climate-related harm. Professor Barry Barton of the University of Waikato noted that the legislation could affect New Zealand’s record for investment stability by interfering with court proceedings.
