NHS maternity services face unsustainable litigation costs
Maternity services in England are facing an unsustainable litigation crisis, with clinical negligence costs tripling since 2006-07. Last year, over £3 billion was spent on maternity negligence, consisting of £2.3 billion in compensation payments and £802 million in legal costs.
The current national provision for accumulated liabilities stands at £60 billion, with £37.5 billion attributed to maternity services. Approximately one in every 500 deliveries in England results in a lawsuit, and the average birth injury claim takes nearly seven years to resolve.
Critics note that between 55 and 60 pence of every pound spent on negligence claims is consumed by legal and administrative fees rather than reaching patients. Furthermore, the lengthy legal processes prevent medical staff from engaging in honest debriefs and learning from incidents, which may hinder the prevention of future errors.
