NHS trusts face scrutiny over single-sex space policy delays

The Midlands Partnership University NHS Foundation Trust (MPFT) has informed staff that its policies regarding transgender inclusion and single-sex accommodation will not change immediately. Under current MPFT rules, patients and staff are permitted to use facilities, such as toilets and showers, that match their gender identity rather than their biological sex.

This decision follows the implementation of new guidance from the Equality and Human Rights Commission (EHRC), which states that single-sex services should be organized around biological sex. The EHRC code suggests that transgender individuals should use facilities matching their biological sex or separate mixed-sex alternatives. MPFT stated it is waiting for further direction from NHS England before making changes.

NHS England has not yet provided a timeline for implementing new single-sex space guidelines, stating that updated policies will be published "shortly." An internal source suggested the delay is due to the Cabinet Office coordinating a government-wide response, though a Cabinet Office insider denied this, stating that organizations are free to update policies in line with the Supreme Court ruling. Some female employees and sex-based rights advocates have expressed concerns regarding the delay and the continued use of outdated policies.
