Germany challenges Nicaragua's ICJ case over Gaza genocide allegations
Nicaragua has brought a case against Germany before the International Court of Justice (ICJ), alleging that Berlin is facilitating genocide in the Gaza Strip. Nicaragua contends that Germany has breached the 1948 Genocide Convention and international humanitarian law by providing military equipment and support to Israel, despite being aware of the risks of genocidal acts being committed.
Germany has formally challenged the ICJ's jurisdiction and the admissibility of the claims, seeking to have the case dismissed. German legal representatives argue that the court lacks competence to address the matter, noting that the dispute does not constitute a classic bilateral controversy between states and that Israel is not a party to the proceedings. Berlin maintains that its arms exports are subject to strict authorization processes and that its support for Israel is rooted in historical responsibility without violating international law.
The current hearings at The Hague focus on these preliminary objections regarding jurisdiction. While the ICJ rejected Nicaragua's 2024 request for emergency measures to immediately halt arms exports, the court did not dismiss the case entirely, allowing the legal process to continue toward a potential examination of the allegations on their merits.
