Nicușor Dan challenges Voluntari municipality law at Constitutional Court
Romanian President Nicușor Dan has submitted a challenge to the Constitutional Court regarding the law declaring Voluntari, Ilfov, a municipality. The law, passed by Parliament in September, was sent to the President for promulgation on October 3, 2026.
Dan argues that the legislation lacks sufficient justification and violates constitutional principles of legality and legal certainty. He contends that the law fails to demonstrate a real social need or provide a clear analysis of the fiscal impact on residents, noting that the primary certain effect is an increased tax burden. The President also points to inaccuracies and contradictions in the documentation, including questionable data regarding hospitals, green spaces, and education.
A central point of the challenge is the reliance on a 2004 referendum. Dan argues that the population structure has changed fundamentally since then, noting that while there were approximately 30,000 residents in 2004, the population reached 49,417 by July 2025. Furthermore, he highlights that a subsequent 2009 referendum, in which a majority of participants supported transforming Voluntari into Bucharest’s Sector 7, was omitted from the documentation. The Economic and Social Council advised against the proposal, and the Government did not support it.
