Nigeria implements new procurement rules and contractor debarment

The Nigerian Federal Government has directed the strict implementation of the National Guideline on Debarment of Contractors, Consultants, and Service Providers. According to a circular issued by the Secretary to the Government of the Federation, Sen. George Akume, defaulting contractors may be excluded from public procurement for periods ranging from three to five years.

The Bureau of Public Procurement (BPP) stated that these measures aim to prevent fraud and corruption by ensuring violators of the Public Procurement Act, 2007, are reported and barred from bidding for federal contracts or acting as agents for other providers. Debarred entities will be listed in the BPP database and published on its website.

Additionally, the government is enforcing a mandatory 14-day standstill period for public procurement. Once a contract award recommendation is approved, a Notice of Intended Award must be issued to all participating bidders. No contract agreements or letters of award can become effective until this period expires, allowing unsuccessful bidders to seek clarification or lodge complaints.
