Nigeria wins ICC arbitration against Sunrise Power over Mambilla project
An International Chamber of Commerce (ICC) tribunal in Paris has ruled in favor of Nigeria, dismissing a multi-billion dollar arbitration claim brought by Sunrise Power and Transmission Company Limited regarding the Mambilla Hydroelectric Power Project in Taraba State.
The tribunal rejected Sunrise Power’s claims, including a demand for $400 million consisting of a $200 million settlement sum and a $200 million default payment. It also dismissed the company’s request for a declaration that Nigeria had breached contractual obligations under a settlement agreement.
The panel ruled that Sunrise promoter Leno Adesanya is bound by the arbitration agreement and affirmed the tribunal's jurisdiction over Nigeria’s counterclaim against him and his firm. The tribunal ordered Sunrise Power and Adesanya to reimburse Nigeria for 75 per cent of its legal fees and expenses, which were assessed at $11,819,506.51. Of this, $2.5 million will be recovered from ICC escrow funds, leaving approximately $9.32 million to be paid by the claimants with 10 per cent annual compounded interest.
President Bola Tinubu hailed the decision as a major victory that clears the single biggest legal hurdle stalling the 1,500MW Mambilla project. Sunrise promoter Leno Adesanya stated that the company is reviewing the award and considering all lawful options for next steps.
