Nigeria wins ICC arbitration over $400 million Mambilla project claim
An International Chamber of Commerce (ICC) tribunal in Paris has rejected a $400 million claim brought by Sunrise Power and Transmission Company against the Nigerian government regarding the Mambilla hydroelectric project.
The tribunal ruled that the settlement agreements relied upon by Sunrise were not binding because the officials who signed them lacked the necessary presidential approval to commit the state. Furthermore, the tribunal found the agreements were tainted by corruption and contrary to Nigerian public policy.
As a result of the ruling, Sunrise and its promoter, Leno Adesanya, have been ordered to reimburse Nigeria for a portion of its legal defense costs. Nigerian Attorney-General Lateef Fagbemi stated that the decision removes a major legal obstacle to the 3,050-megawatt project, which has faced delays for nearly two decades. Resolving this dispute is seen as a critical step toward securing financing from the China Export-Import Bank.
Despite this victory, Nigeria faces a separate arbitration claim from Sunrise exceeding $2.7 billion.
