Nigeria wins ICC arbitration against Sunrise Power over Mambilla project
An International Chamber of Commerce (ICC) tribunal in Paris has ruled in favor of Nigeria, dismissing a $2.35 billion claim brought by Sunrise Power Transition Company regarding the Mambilla Hydropower Project.
The tribunal also rejected a $400 million settlement claim and found that previous settlement agreements involving Sunrise were products of corruption and unenforceable under Nigerian public policy. The ruling criticized former Attorney-General Abubakar Malami, finding that he and former Minister of Power Saleh Mamman lacked the authority to bind the federal government and that Malami had reached a corrupt deal with Sunrise promoter Leno Adesanya.
As a result of the decision, the tribunal ordered Sunrise Power and Leno Adesanya to reimburse Nigeria approximately $11.82 million, representing 75 percent of the country’s legal and arbitration expenses.
