Ninth Circuit preserves LAHSA’s role in Los Angeles homelessness system

The U.S. Court of Appeals for the Ninth Circuit has rejected an attempt by the federal government to suspend a court order protecting the Los Angeles Homeless Services Authority (LAHSA). The ruling dissolves an administrative stay and maintains a preliminary injunction against the U.S. Department of Housing and Urban Development (HUD), preserving LAHSA’s role in administering regional homelessness programs and federal funding.

As a result of the ruling, HUD cannot withhold federal grants already approved for fiscal year 2025 and must release them according to the normal schedule. The court also upheld LAHSA’s position as the Collaborative Applicant for Los Angeles County, a critical role for the upcoming FY2026 Continuum of Care funding application due by October 14. Additionally, LAHSA remains the lead for the Homeless Management Information System and the Coordinated Entry System.

In a related development, the Los Angeles Continuum of Care Board has advanced a proposal to designate Los Angeles County as the region’s lead applicant for HUD funds. This contingency plan would take effect if LAHSA remains suspended from its roles. The proposal must now be finalized by the CoC’s general membership, which includes various organizations working to address homelessness in the county.
