Nord Stream operators' accessory prosecution rejected by court

The Hanseatic Higher Regional Court has rejected the applications for accessory prosecution filed by Nord Stream AG and Nord Stream 2 AG in the legal proceedings concerning the explosion of the Nord Stream pipelines.

The court's 3rd Criminal Senate ruled that the companies failed to demonstrate the 'special reasons' or procedural vulnerability necessary to justify such a status. While the operators argued that the destruction of the pipelines caused 'existential damage,' the court found that the estimated restoration costs, totaling in the mid-hundreds of millions of euros, did not constitute a total economic loss when compared to the original investments of 7.4 billion and 9.5 billion euros.

Additionally, the court noted that broader economic consequences were the result of political reactions rather than the explosion itself. The court also denied the right to an accessory prosecution for the purpose of defending against potential blame from the defendant, stating there was no evidence such accusations would be made in the main trial. The companies retain the right to reapply if the legal situation changes.
