North Carolina agencies expand immigration enforcement cooperation with ICE
North Carolina state agencies have begun implementing new immigration enforcement measures following the passage of the North Carolina Border Protection Act (SB-153). The legislation, which was enacted after the state legislature overrode Governor Josh Stein's veto, requires four major agencies—the State Highway Patrol, the Department of Public Safety, the Department of Adult Correction, and the State Bureau of Investigation—to establish cooperation agreements with U.S. Immigration and Customs Enforcement (ICE) under the 287(g) program.
Under these agreements, designated and trained state officials are authorized to perform specific federal immigration enforcement functions. This includes the authority to question individuals during routine traffic stops or while in custody to determine their citizenship or legal residency status. If an official cannot determine an individual's status through questioning or document review, they are required to consult with ICE.
Civil rights organizations, including Siembra NC, have issued advisories to motorists, noting that while North Carolina law requires drivers to provide licenses, registration, and proof of insurance, the U.S. Constitution protects the right to remain silent regarding questions about birthplace or immigration status.
