North Dakota judge to decide Beef Commission membership lawsuit

South Central Judicial District Judge Jackson Lofgren is set to rule on a lawsuit challenging the constitutionality of the state's Beef Commission appointment process. The case was brought by the Ranchers Rights Initiative, represented by cattlemen Kenneth Graner, Michael Heaton and Jeremy Maher, who argue that the law favors the North Dakota Stockmen’s Association and creates a closed class for commission seats.

The Beef Commission, composed of nine members appointed by the governor, oversees the $2-per-head beef checkoff that generated more than $1.5 million in 2024‑2025 for promotion, education and research. The lawsuit names Republican Governor Kelly Armstrong, the commission and the state as defendants, alleging the statute violates the state constitution by elevating a privileged association over other stakeholders. Judge Lofgren indicated he will issue his opinion promptly.
