North Macedonia promotes new detention standards handbook

North Macedonian Minister of Justice Jeton Chashivari attended the promotion of a new handbook focused on the application of detention measures under Article 5 of the European Convention on Human Rights.

Chashivari emphasized that the handbook serves as a practical tool to improve judicial and prosecutorial practices by ensuring the consistent application of European human rights standards. He stressed that detention must not be applied automatically or serve as a substitute for a final verdict, noting the necessity of upholding the presumption of innocence.

The Minister stated that deprivation of liberty should only be justified when there is a specific, real, and individually determined reason, and when the objectives of the proceedings cannot be achieved through less restrictive measures. He also highlighted the importance of following the precedents set by the European Court of Human Rights in cases involving North Macedonia.
