Germany: Smoke detector replacements and legal rulings on alarm costs
In North Rhine-Westphalia, a large-scale replacement of smoke detectors is approaching. Since the mandatory installation requirement took effect on January 1, 2017, many devices equipped with 10-year fixed batteries are reaching the end of their functional lifespan. The property owners' association Haus & Grund notes that landlords are responsible for the costs of replacing these devices in rental properties, while tenants must allow access for installation. This requirement also applies to owner-occupied apartments.
Separately, in Saxony, the Higher Administrative Court (OVG) Bautzen ruled that municipalities cannot charge property owners for fire department call-out costs resulting from false alarms triggered by domestic smoke detectors. The court determined that such detectors do not qualify as automatic fire alarm systems under the Saxon State Disaster Control Act, meaning local authorities lack the legal basis to expand cost-recovery regulations through municipal statutes.
