Novo Nordisk Sues Eli Lilly Over GLP‑1 Dosage Advertising Dispute
Novo Nordisk filed a lawsuit on 21 July 2026 in a US federal court in New Jersey, accusing Eli Lilly of false advertising under the Lanham Act. The complaint alleges that Lilly’s promotional material for its GLP‑1 weight‑loss drugs Zepbound and Mounjaro highlights the highest approved doses (10 mg and 15 mg) alongside the lower doses of Novo’s Wegovy and Ozempic (1.7 mg and 2.4 mg), ignoring the FDA’s recent approval of a higher Wegovy dose of 7.2 mg.
Novo seeks removal of the advertisements and damages, arguing the comparisons mislead consumers about the relative efficacy of the products. Lilly defends its campaign by citing results from the 2024 SURMOUNT‑5 study that it says support the superiority of its formulations. The case emerges amid intense competition in the rapidly growing GLP‑1 market, where both companies operate large manufacturing facilities in North Carolina. Earlier FDA warnings in September 2025 about misleading safety claims in celebrity‑endorsed ads add context to the dispute. Investors view the lawsuit as a signal of Novo’s more aggressive stance against perceived market distortions.
