NSW Local Court judges embroiled in legal battle over misconduct claims

Deputy Chief Judge Sharon Freund of the NSW Local Court has initiated legal proceedings in the state’s Court of Appeal to challenge decisions made by the Judicial Commission of NSW.

Freund originally filed a complaint in May against Chief Judge Michael Allen, alleging he engaged in bullying conduct. The Judicial Commission dismissed the complaint in June, finding it was not substantiated. Furthermore, the commission recorded that several members believed the complaint was not brought in good faith and was intended to deflect an inquiry into Freund’s own conduct regarding potential irregular behavior and partiality.

Freund is seeking to overturn the commission’s decisions, arguing they were made outside its legal powers and are damaging to her reputation. Following a letter from Chief Judge Allen to NSW Attorney-General Michael Daley regarding the commission's findings, Daley referred the matter back to the commission, which subsequently referred it to a conduct division for investigation.
