NUPRC clarifies helicopter levy and offshore platform exemptions

The Nigerian Upstream Petroleum Regulatory Commission (NUPRC) has clarified the application of aviation-related charges for helicopter operations. While the US$300 Helicopter Levy for Air Navigational Services remains mandatory for upstream oil and gas operators, the Terminal Navigational Charge (TNC) will not apply to helicopter landings at private offshore facilities and platforms.

The decision follows a review by a Ministerial Review Committee, established by the Minister of Aviation and Aerospace Development, Festus Keyamo, to address stakeholder concerns regarding the structure and implementation of these fees. The committee determined that the US$300 levy per landing must continue to be paid to the Nigerian Airspace Management Agency (NAMA).

The NUPRC specified that the TNC remains applicable to helicopter operations not supporting upstream petroleum activities, such as medical evacuations, private charters, and agricultural operations. This clarification aims to provide regulatory certainty for oil and gas operators and their aviation contractors regarding cost-recovery arrangements and invoicing.
