Nurse Sandie Peggie cleared to appeal NHS Fife tribunal ruling

The Employment Appeal Tribunal has granted nurse Sandie Peggie permission to appeal the findings of an earlier employment tribunal against NHS Fife. The original tribunal, held in Dundee in December 2025, upheld Peggie’s claim that the health board harassed her after she was required to share a women’s changing room with transgender doctor Beth Upton at Victoria Hospital in Kirkcaldy. While the tribunal found harassment by NHS Fife, it dismissed her allegations of discrimination, indirect discrimination and victim‑isation.

On 31 July 2026 the appeal was allowed to proceed on 13 grounds, with a full hearing expected early in the next year. The case has become a flashpoint in the UK gender‑rights debate, drawing support from gender‑critical groups and public figures such as J.K. Rowling. Dr Upton no longer works for NHS Fife.
