Emily Gallagher argues shoplifting for biological need should not be illegal

New York State Assemblywoman Emily Gallagher, a member of the Democratic Socialists of America, has drawn criticism after suggesting that shoplifting for basic necessities should not be criminalized. Speaking at a news conference outside Manhattan Criminal Court alongside advocates from Court Watch NYC, Gallagher argued that individuals stealing items like soap and toothpaste are driven by ‘biological need’ due to extreme wealth disparity.

Gallagher characterized these actions as ‘crimes of poverty’ and stated that the city is choosing to protect billion-dollar corporations, such as CVS and Walgreens, over struggling residents. She advocated for a ‘treatment-not-jail’ approach to criminal justice and called on Mayor Zohran Mamdani to end ‘broken windows policing’ tactics.

Critics, including local business owners and Republican officials, have condemned the remarks, arguing that such stances encourage theft and threaten the viability of the retail sector. Opponents noted that many retailers have already been forced to lock merchandise behind plastic cases due to rising theft concerns.
