Oaxaca lawsuits challenge legal barriers to euthanasia access
Two amparo lawsuits have been filed in Oaxaca, Mexico, seeking to remove legal obstacles to euthanasia and recognize the right to decide on end-of-life processes for those with incurable or terminal illnesses.
One lawsuit was brought by an indigenous woman and cancer survivor to protect her right to a dignified death should her illness return. The Ninth District Court has admitted this case. A second lawsuit was filed by a physician seeking legal protection to assist patients in making informed end-of-life decisions without facing criminal charges.
The legal challenges target the General Health Law and the Oaxaca Penal Code, which currently criminalize assisting a person in ending their life. The Proyecto Luciérnaga collective, which is supporting these efforts, noted that the Supreme Court of Justice of the Nation has also admitted a similar resource for analysis.
