Oberwart Clinic heart surgery authorization overturned by court

The Burgenland State Administrative Court (LVwG) has overturned the authorization for the heart surgery department at the Oberwart Clinic. The ruling follows appeals from the Ministry of Health and the Austrian Health Insurance Fund (ÖGK).

The court found that the original authorization process used criteria for determining medical necessity that contradicted legal standards and judicial precedents. Consequently, the matter has been referred back to the administrative authority to issue a new decision.

Burgenland Governor Hans Peter Doskozil stated that the department's operations will continue uninterrupted and that scheduled surgeries remain valid. He announced that 'Gesundheit Burgenland' will file an extraordinary revision and request a stay of execution. Doskozil emphasized that the medical need for the facility is proven by daily operations, despite the formal and methodological errors identified in the initial application.
