Odisha Assembly passes stamp duty amendment for apartments

The Odisha Legislative Assembly has passed the Indian Stamp (Odisha Amendment) Bill, 2026, to streamline the registration and transfer process for apartment units within the state. Presented by Revenue and Disaster Management Minister Suresh Pujari, the bill aims to simplify the transfer of common areas and facilities—such as project land, garages, stairwells, and elevators—from promoters to the Association of Allottees.

Under the new legislation, a nominal stamp duty of Rs 50,000 will be charged on the deed transferring these common areas and facilities. This replaces a previous registration fee cap of Rs 20,000. Following this transfer, the undivided proportionate share in common spaces will be included in individual apartment transfer documents, which will be subject to a uniform stamp duty rate of 5%.

The amendment seeks to reduce the financial burden on apartment owners by replacing the previous slab-based stamp duty system with a uniform rate, while simultaneously safeguarding the state government’s revenue interests.
