Ogér ordered to provide member data for tax investigation

The North Holland court has ordered the fashion brand Ogér to provide the Dutch Tax Administration (Belastingdienst) with detailed data regarding its business club members from 2019 to 2025. The investigation follows suspicions that members used their memberships to claim private clothing expenses as business costs.

The court ruled that Ogér must disclose names, addresses, membership types, shop credits, and payment proofs. The judge noted that the membership fees primarily covered shop credits, giving the clothing component an “evident non-business character.”

In response, the law firm DHKV Advocaten has opened a claim desk for affected members and filed a Freedom of Information (Woo) request to examine prior consultations between Ogér and tax authorities. Legal experts suggest a “wave of assessments” is expected later this year, with potential liabilities for high-tier members reaching tens of thousands of euros in taxes, VAT, interest, and penalties.
