Oktoberfest subletting rules and regulations in Munich
As the Oktoberfest attracts international visitors, demand for accommodation in Munich and surrounding areas like Augsburg rises, leading many to consider subletting rooms or apartments for profit.
To avoid legal issues, tenants must obtain written permission from their landlords, as unauthorized subletting can be grounds for termination. In Munich, the 'Zweckentfremdungssatzung' (misuse of housing statute) limits the subletting of entire apartments to tourists to a maximum of 56 days per calendar year. Violating these regulations when renting out entire apartments can result in fines of up to 500,000 euros.
However, subletting individual rooms does not have a specific time limit, provided the primary tenant continues to reside in the property. New requirements are expected to be implemented starting with the 2027 festival regarding listings on rental portals.
