Olavarría telecommunications company challenges municipal tax in federal court

A telecommunications company based in Olavarría, Argentina, has filed a lawsuit in Federal Court seeking to declare a municipal tax unconstitutional. The dispute involves a claim by the municipality for 135,285,000 pesos regarding the use of public space for telecommunications infrastructure for the 2025 fiscal period.

The company argues that the municipal assessment, based on 9,000 poles and 492,000 meters of aerial cabling, violates federal regulations. Specifically, the firm cites Article 39 of National Law 19,798 and Article 89 of Law 27,078 (Argentina Digital), which provide exemptions from taxes for the use of public domain for telecommunications services. The case is currently being processed by the Federal Court of Azul No. 2 under Judge Martín Bava.
