OLG Hamm rules Pedelec rider fully liable for skater’s fall
The Oberlandesgericht (OLG) Hamm upheld a lower‑court ruling that a Pedelec rider is solely liable for an inline skater’s fall on a shared 2.20 m‑wide path. The court found the cyclist breached the general duty of care by not keeping a sufficient safety distance and by failing to issue a clear warning while overtaking, even though no physical contact was proven. The rider therefore must compensate the skater for pain and other damages. The decision, cited as Az. I‑7 U 5/24, reinforces the responsibility of cyclists and e‑bike users to protect vulnerable road‑users in constrained spaces.
