Ombudsman Institution of Turkey rejects military service leave claim
The Ombudsman Institution of Turkey (KDK) has rejected an application from a contracted health technician seeking to have military service included in the seniority calculation for annual leave.
The applicant, a technician working at a Public Health Laboratory in Istanbul, argued that excluding military service violated constitutional rights to rest and established general communiqués. However, the Ministry of Health's Legal Services General Directorate responded that current decrees for contracted personnel specifically exclude service in military institutions from these calculations.
The Ministry further noted that Article 4/B of Law No. 657 does not provide a basis for including military service when determining annual leave for such staff. Following an investigation, the KDK concluded that the administration's refusal was consistent with existing legislation and was not contrary to law or equity. The institution informed the applicant that the judicial path remains open.
