Poland: Companies bypass new deposit return system via product fees

In Poland, companies and state institutions are finding ways to bypass the new deposit return system. While ordinary citizens must deal with the system and its associated costs, certain entities are opting out by paying a product fee instead.

The current legislation allows beverage producers to remain outside the deposit system by paying a fee for packaging introduced to the market without a deposit. The Ministry of Climate and Environment describes this as a ‘soft start’ to the reform. In 2026, the fee is set at 1 PLN per kilogram of packaging, while producers opting out entirely face a triple rate of 3 PLN per kilogram. For many institutions, such as police stations, government offices, and workplaces, the logistical, storage, and administrative costs of participating in the full deposit system are higher than paying these penalties.
