Orissa High Court seeks clarification on teacher eligibility test requirements

The Orissa High Court has requested clarification from the state government regarding whether the Odisha Teacher Eligibility Test (OTET) requirement applies to teachers appointed before September 3, 2001. The court issued this direction while restraining further promotion proceedings in the Dhanakauda block of Sambalpur district.

The legal challenge follows a petition by a teacher who was excluded from a promotion list for allegedly failing to clear the OTET. The petitioner argued, citing Supreme Court precedent, that teachers appointed before the specified cut-off date should not be required to pass the eligibility test.

This local dispute aligns with broader legal mandates from the Supreme Court of India. Under a landmark ruling, in-service teachers recruited before the Right to Education Act of 2010, who have more than five years until retirement, are required to qualify for the Teacher Eligibility Test (TET) to remain in service. While the court previously extended the deadline for qualifying to August 31, 2028, the requirement remains a significant factor for millions of teachers across the country seeking to maintain their positions or pursue promotions.
