OVG Münster to hear case on long-term police knife bans
The Higher Administrative Court (OVG) in Münster is set to hold an oral hearing on September 29 to address the legality of long-term knife bans issued by police in several cities within North Rhine-Westphalia.
The case stems from a lawsuit filed by an 18-year-old from Wuppertal. There is currently a legal disagreement between courts regarding the authority to issue such bans. The Administrative Court of Düsseldorf previously ruled in September 2025 that the Wuppertal ban was predominantly unlawful, stating that only the federal government can regulate general knife bans through the Weapons Act.
However, in a July 2025 emergency proceeding, the OVG Münster provided a preliminary assessment suggesting that police may use general police law for danger prevention to issue individual knife bans without needing a specific legal basis. The upcoming hearing will determine the final standing of these police measures.
