Pakistan court to hear challenge against Khyber-Pakhtunkhwa CM election

Pakistan’s Federal Constitutional Court (FCC) is scheduled to hear a petition challenging the election of Sohail Afridi as the Chief Minister of Khyber-Pakhtunkhwa (K-P). A three-member bench, led by Chief Justice Amin-ud-Din Khan, will review the case on September 14.

The petition was filed by Sher Afzal Marwat, a former lawmaker and estranged leader of the Pakistan Tehreek-e-Insaf (PTI) party. Marwat is seeking the reinstatement of former Chief Minister Ali Amin Gandapur and the quashing of Afridi’s election.

The legal challenge argues that Afridi’s nomination was illegal because it was directed by PTI founder Imran Khan. The petitioner contends that because Khan is currently convicted and constitutionally disqualified under Articles 62 and 63 of the Constitution, he lacks the legal capacity to issue binding political directives or nominate state functionaries. Furthermore, the petition claims that the resignation letters submitted by Gandapur in October 2025 were invalid as they were issued under the unconstitutional dictation of a disqualified individual.
