Palermo court orders transparency for construction near historic site
The Third Section of the Regional Administrative Court (TAR) for Sicily has ruled that the Municipality of Palermo must disclose all documentation, permits, and authorizations regarding a construction site located adjacent to a protected 16th-century wall.
The ruling follows an appeal by Salvatore Di Vitale, a former president of the Court of Palermo, who sought to verify the legality of the project after luxury housing advertisements appeared near his residence. Di Vitale expressed concern for the preservation of the nearby historical ruins and had requested access to records from both the Municipality and the Superintendency of Cultural and Environmental Heritage.
While the Superintendency reported no relevant documents in its archives, the Municipality failed to respond to the initial request. The TAR Sicily annulled this silence, affirming that citizens in a “qualified position” due to proximity to such works have a legitimate right to ensure project regularity and transparency.
