Palermo Court rules on joint mortgage reimbursement rights
A court in Palermo has ruled that an ex-spouse is not entitled to reimbursement for mortgage payments if the property in question belongs exclusively to the other partner. Under Italian civil law, while co-signatories are typically held jointly and severally liable for a debt, a legal exception applies when an obligation is entered into for the exclusive interest of only one party.
In this specific case, the court determined that the man's signature on the mortgage served solely to provide financial guarantees to the bank for the benefit of his wife, who was the sole owner of the property. Consequently, the court overturned an injunction seeking reimbursement, noting that the economic burden of the debt rests entirely with the sole owner when the co-signer's involvement was purely to secure the loan.
