Palma di Montechiaro Court of Appeal Overturns Demolition Order

The Court of Appeal in Palermo revoked a demolition order affecting a municipal building in Palma di Montechiaro, stating that the municipality correctly interpreted and applied article 31 of the Italian Building Code (D.P.R. 380/2001).

The judgment praised the administrative process led by Mayor Stefano Castellino, including a council resolution that declared the property’s maintenance a prevailing public interest because it would house families with minors and other protected persons. The legal defence was handled by attorney Santo Lucia. Mayor Castellino called the decision “a recognition of the correctness of the administrative procedure” and added, “Ovviamente riguarda una serie di specifiche casistiche e non tutti i casi indistintamente.”
