Papa Johns manager wins landmark UK employment tribunal case

An Employment Tribunal has ruled in favor of Ashwani Kumar, a branch manager at a Papa Johns franchise in Harlow, Essex, after he was dismissed for refusing to accept cash wages.

Kumar requested that his income tax and National Insurance contributions be legally deducted and paid to HM Revenue and Customs (HMRC). Investigations revealed that while the employer provided payslips showing these deductions, the funds were never actually transferred to the tax authorities.

The tribunal found the dismissal to be ‘automatically unfair,’ noting that the termination was a direct result of the employee exercising his legal right to demand proper tax reporting and accurate payslips. Additionally, the court identified violations regarding unpaid wages for December 2024 and the denial of statutory annual leave. The employer, identified as EEM London and EEM Holdings under owner Abdul Sattar Askar, was found liable for the unfair dismissal and irregular financial practices.
