Brazil energy and telecom sectors face regulatory shifts

Brazil is seeing significant regulatory and economic developments across the energy and telecommunications sectors. In Pará, the state government is preparing legal action to block an electricity tariff hike approved by ANEEL for Equatorial Pará, which could impact approximately 3.12 million consumers with increases of up to 8.09%.

In the energy sector, industry executives and specialists recently met in Rio de Janeiro to discuss the impacts of the national Tax Reform on electricity generation, transmission, and distribution. The debate focused on how the implementation of CBS and IBS will affect long-term contracts, investments, and the economic balance of concession projects.

Regarding telecommunications, the Federal Court of Accounts (TCU) has urged Anatel and Aneel to expedite the revision of rules for sharing utility poles between energy distributors and telecom companies to reduce legal uncertainty and costs for smaller providers. Additionally, Anatel has issued precautionary measures against several operators, including TIM and Algar, to combat 'spoofing' practices where call origins are illegally altered. Meanwhile, the TCU approved the renewal of radiofrequency authorizations for Telefônica Brasil (Vivo), despite noting procedural and regulatory flaws in Anatel’s methodology.
