Paraguay proposes restrictions for child support debtors

A legislative initiative in Paraguay seeks to reform Law No. 6506/2020 to address the gap between high numbers of child support default judgments and the low number of debtors actually registered in the National Registry of Food Debtors (REDAM).

The proposal aims to integrate REDAM telematically into the main judicial process. Once a debtor is declared in default, courts would be required to order their registration within 48 hours or automatically in digitalized jurisdictions. To prevent institutional violence and re-victimization, beneficiaries could request data updates directly within the case file.

Furthermore, the project expands restrictions for those on the registry. It proposes requiring a certificate of no outstanding child support to process or renew driver's licenses, passports, and travel permits. Other restrictions include notary operations, public administration contracting, civil service exams, and applications for elective office. The Supreme Court of Justice would be tasked with coordinating real-time digital consultation mechanisms with migration, police, and transit authorities.
