Paraguayan Supreme Court rejects EBY unconstitutionality challenge
The Constitutional Chamber of the Supreme Court of Paraguay unanimously rejected an unconstitutionality action filed by the binational hydroelectric entity EBY. The legal challenge was part of a labor lawsuit involving Juan Ángel Peralta Barrios, who sought reinstatement and back pay.
EBY's legal representative, Esther Dávalos Chávez, argued that the entity's binational status should influence the ruling to maintain good relations with the partner state. However, the court dismissed the action, upholding previous rulings that ordered the reinstatement of the worker. The court noted that evidence proved the worker had over 10 years of seniority, qualifying him for special stability, and that the dismissal lacked the legally required prior trial.
