Paris court acquits mother for withholding child due to abuse allegations

A Paris criminal court has acquitted a mother of the charge of non-presentation of a child, a rare legal decision involving the concept of ‘état de nécessité’ (state of necessity). The woman had repeatedly refused to hand over her son, then aged three, to his father following allegations of sexual violence made by the child.

While the refusal to comply with visitation rights typically constitutes a criminal offense under Article 227-5 of the French Penal Code, the court ruled that the mother's actions were justified to protect the child from imminent danger. The judges noted that her behavior was proportionate, as she had notified police and authorities regarding the child's allegations and behavior prior to withholding him.

The case is considered exceptional because it marks one of the first instances where a ‘protective parent’ was not convicted for failing to uphold custody arrangements due to suspected abuse.
