Paris court orders TotalEnergies to count customers' emissions

On 25 June 2026 the Paris Judicial Court ruled that TotalEnergies must incorporate the greenhouse‑gas emissions generated by the combustion of its oil and gas products by customers (so‑called “scope 3” emissions) into its 2017 duty‑of‑vigilance plan. The company was given six months to amend the plan, and the court reserved the right to review compliance in January 2027. The judges rejected TotalEnergies’ argument that scope 3 emissions fall outside the law, stating that they are “part of the emissions resulting from the group’s activity.” Plaintiffs – a coalition of NGOs (Notre Affaire à Tous, Sherpa, France Nature Environnement) and the City of Paris – welcomed the decision as historic, with Alice Timsit, Paris’s deputy mayor for ecological transition, saying “for the first time, the judge recognises that climate risks fall within the duty of vigilance.” The ruling does not order specific cuts to oil or gas production, but it may set a precedent for climate‑related corporate liability in France and elsewhere. TotalEnergies said it was satisfied that no production‑reduction mandates were imposed.
