Parking scarcity drives legal disputes over property rights

Legal and practical conflicts regarding parking spaces are increasing as urban space becomes scarcer. Recent court rulings in Germany highlight the growing economic and legal value of parking rights.

The Federal Court of Justice has clarified that property owners can demand the removal of obstructions even if a vehicle is only blocking a driveway and has not yet entered the property itself. Furthermore, the District Court of Ingolstadt ruled that a single instance of unauthorized parking on private property can create a presumption that future violations are likely, allowing owners to seek injunctions more readily.

On a local level, enforcement of traffic regulations is creating practical challenges. In Unna-Massen, authorities have begun issuing fines for parking on sidewalks, a practice previously tolerated by residents to keep roads clear. However, moving vehicles back onto the street has created new issues, such as obstructing the passage of large agricultural machinery.
