Peabody Energy Australia settles $1 million claim with injured mine worker
Former mine worker Mr. Ticehurst, who had worked nearly two decades in the mining industry, was injured on 8 December 2021 while driving a coal dump truck on a rough, potholed road at the Wilpinjong Mine near Mudgee. He suffered a prolapsed disc at the C5 vertebrae and has been unable to work since.
A court hearing in early 2026 found that Peabody Energy Australia Pty Ltd failed to meet its duty of care. The company’s argument that the worker was at fault was rejected, and Judge Wendy Strathdee criticized the employer’s witness as “most unimpressive.” The judge noted that safety protocols could not shift the responsibility for unsafe road conditions onto the driver. Peabody Energy agreed to a seven‑figure payout to settle the claim, highlighting issues of workplace safety and employer liability in the Australian mining sector.
