Pennsylvania disease regulation proposals spark political debate

The administration of Pennsylvania Governor Josh Shapiro has proposed an overhaul of state disease regulations, sparking significant political debate and a surge of public feedback. The 502-page document, signed by Health Secretary Debra Bogen, aims to update standards for communicable and noncommunicable diseases that have not seen a major update in 25 years. The proposal seeks to expand the list of reportable conditions and align with modern scientific guidance to improve public health safety.

State Republicans have criticized the proposal, arguing that the new rules could allow for warrantless entry into private homes and grant the governor excessive emergency powers. In response, Democratic Representative Arvind Venkat stated that critics are “jumping to extreme conclusions” and emphasized the necessity of updating outdated regulations.

The Independent Regulatory Review Commission (IRRC) has received over 4,000 public comments, most of which were opposed to the filing. IRRC Executive Director David Sumner described the filing as “one of the most significant rulemakings” in recent years. The commission will now evaluate the proposal for clarity, reasonableness, and compliance costs, a process that may take up to two years.
