Pennsylvania Supreme Court denies extension for skill game deadline

The Pennsylvania Supreme Court has denied requests to extend a deadline for the removal of ‘skill games’ from various establishments across the state. Following the court’s refusal to grant an extension, the machines—which the court previously ruled are functionally equivalent to illegal slot machines—must be removed or licensed by the state Gaming Control Board by Tuesday.

State lawmakers had petitioned the court to delay enforcement until February 10 to allow time for the legislature to develop a regulatory and taxing framework. However, the Attorney General’s office argued the request was filed too late and that the legislators lacked standing.

The legal impasse has significant economic implications. Governor Josh Shapiro previously estimated that legalizing and taxing these games at a 52% rate could generate $2 billion in annual state revenue. While some legislators have proposed much lower tax rates, the expiration of the current stay means law enforcement may soon begin prosecuting venues that continue to operate the devices without proper licensing.
