Pennsylvania Supreme Court weighs drug overdose prosecution protections

The Pennsylvania Supreme Court is considering whether to establish new legal protections for defendants accused of supplying drugs that lead to fatal overdoses. The court is reviewing two cases to determine if “jointly and constructively” acquiring and using drugs should serve as a legal defense for drug delivery resulting in death charges.

Critics of current prosecution trends argue that these charges often target fellow drug users rather than high-level dealers. Between 2021 and 2025, more than 680 charges of drug delivery resulting in death—which carry a maximum sentence of 40 years—were filed in the state. While supporters believe these prosecutions ensure accountability, opponents argue the threat of long prison sentences may discourage individuals from seeking medical help during an overdose.

Some justices have expressed skepticism regarding the court's authority to alter these laws, suggesting such changes may fall under the jurisdiction of the legislature. Justice David Wecht noted in previous arguments that while certain cases appeared “overcharged and definitely oversentenced,” the court's ability to intervene remains uncertain.
