Pension distribution rules for multiple marriages
In cases where a deceased individual had multiple marriages, the distribution of survivor's pensions depends on specific national regulations. In France, for successive marriages involving divorce, the pension from the basic regime and Agirc-Arrco is typically distributed pro rata based on the duration of each marriage relative to the total marriage duration.
Regarding cases of polygamy or bigamy, French law as of August 2021 generally reserves the pension for the spouse whose marriage respects monogamy at the earliest date, though a March 2022 decree allows for pro rata distribution when multiple marriages have produced legal effects.
In Algeria, the Caisse nationale des retraites (CNR) applies rates based on Law No. 83-12, providing 75% for a single surviving spouse and 50% when another beneficiary is present. However, the CNR does not currently publish a confirmed formula for sharing a pension among multiple co-wives, requiring direct verification with the fund.
