Pergamino court orders gas station to pay $7 million for fueling diesel car with gasoline

A civil and commercial court in Pergamino, Argentina, has ordered a service station to pay $7,010,000 plus interest to a customer after an employee mistakenly filled a diesel Renault Clio with gasoline.

The incident occurred on October 15, 2022, when the driver attempted to purchase 2,000 pesos worth of diesel. Although the attendant acknowledged the error and the vehicle was taken to a nearby workshop to drain the tank, the engine failed completely after driving a short distance.

The ruling by the First Civil and Commercial Court of Pergamino classified the incident as a consumer relationship. The judge applied the principle of dynamic burden of proof, noting that the provider possesses greater technical and documentary resources to demonstrate compliance. The court found the company failed in its obligations regarding information and safety. In addition to material damages and moral damages, the sentence includes a punitive civil fine due to the company's response and stance during the judicial process.
