Peru: Legal challenges for Vladimiro Montesinos and bicameralism debates

In Peru, the defense for Vladimiro Montesinos, former head of the National Intelligence Service under Alberto Fujimori, is seeking humanitarian house arrest. Montesinos, who has been incarcerated at the Callao Naval Base for over twenty years, is over 80 years old. His lawyer, Carlos Mariluz, has proposed a residence in San Isidro for the requested house arrest under Law 32181. The Public Ministry has opposed this request, and a hearing is scheduled for November 24, 2026, to determine if the measure is appropriate.

Separately, the implementation of Peru's new bicameral legislative system has faced criticism following the publication of a law delegating powers to the Executive. Analysts have noted procedural errors in the text and structural flaws in the new constitutional reform. Specifically, the current design reportedly limits the Senate's ability to effectively review legislation passed by the Chamber of Deputies, creating a system where the revising chamber lacks the power to modify or reconcile texts, potentially undermining the purpose of a two-chamber legislature.
